These Terms of Service govern your use of elitefundingpartner.com and the services provided by Elite Funding Partners LLC, doing business as Elite Funding Partner (“we,” “us,” or “our”).
By using our website or requesting our services, you agree to these terms. If you do not agree, please do not use our website or services. Acceptance of these terms does not, by itself, constitute consent to receive marketing calls or text messages.
What We Do
Elite Funding Partner provides advisory and referral services for commercial business financing. We help businesses understand potential financing options, identify application requirements, compare proposed costs and terms, and submit authorized requests to third-party funding sources.
We are not a lender. We do not issue financing, make credit decisions, or determine a funding provider’s approval requirements or final terms. Nothing on our website or in our communications constitutes an offer, approval, or commitment to provide financing.
Any financing is provided by a third-party lender or funding provider under a separate agreement. You are responsible for reviewing that agreement, including its costs, payment obligations, security interests, and any personal guarantee, before signing.
Eligibility
Our services are intended for businesses seeking commercial financing. They are not intended for personal, family, or household purposes.
You must be at least 18 years old and authorized to act on behalf of the business for which you request assistance.
Information and Authorization
You agree to provide accurate, current, and complete information and to notify us of material changes relevant to your financing request. You must have authority to provide any business records or personal information you submit.
When you request and authorize us to seek financing on your behalf, you authorize us to provide relevant application information and supporting documents to potential funding sources for that purpose, subject to our Privacy Policy.
Submitting an inquiry does not obligate you to accept an offer. These terms do not, by themselves, authorize us to obtain a consumer credit report. Any required credit-report authorization will be obtained separately.

Fees and Compensation
Any fee payable by you to Elite Funding Partner must be disclosed and agreed to separately in writing. These terms alone do not create an obligation to pay a service fee.
Any applicable referral compensation or other compensation arrangements will be disclosed as required by law. A funding provider’s charges and payment terms are governed by its financing agreement and applicable disclosures.
Text Messaging Terms
Program Description
The Elite Funding Partner business financing messaging program provides messages concerning business financing inquiries, application updates, appointment scheduling, follow-up questions, and document requests.
If you separately consent to marketing texts, we may also send messages about business financing products and services.
Consent and Enrollment
You may enroll through a website form or another process that clearly describes the messages you agree to receive and records your consent.
Providing your mobile number or submitting a general inquiry does not, by itself, authorize automated marketing text messages. If you text us first, we may respond to your inquiry; this does not automatically enroll you in ongoing marketing messages.
Where required, we obtain prior express written consent before sending automated marketing messages.
Consent to receive marketing calls or text messages is not a condition of purchasing or receiving our services.
You confirm that you are the subscriber or authorized user of the mobile number you provide. Please notify us if you change or relinquish that number.
Message Frequency and Cost
Message frequency varies depending on your inquiries, application activity, and messaging preferences.
Message and data rates may apply. Elite Funding Partner does not charge a separate messaging fee. Your wireless provider’s rates and terms apply.
Opting Out
Reply STOP to any text message to opt out. You may also contact us at admin@elitefundingpartner.com or communicate your request by another reasonable method.
After opting out, you may receive one nonmarketing message confirming your request. We will stop further messages from the program unless you provide new consent. We also honor requests to revoke related calling consent as required by applicable law.
We retain limited opt-out records as needed to respect your communication preferences.

Delivery and Carriers
Message delivery depends on your wireless provider and network availability and is not guaranteed. Carriers are not liable for delayed or undelivered messages.
Mobile Privacy
We do not sell or share mobile information with third parties or affiliates for their marketing or promotional purposes. We do not transfer your text-message opt-in information or consent to another business for its own messaging campaigns.
Service providers may access limited mobile information and consent records to deliver messages and manage consent on our behalf. We may also disclose information where legally required. These exceptions do not permit independent marketing use.

No Guarantee of Financing
We do not guarantee approval, funding amounts, rates, costs, repayment terms, or funding timelines.
Any estimates, examples, or preliminary indications are informational and may change following verification, underwriting, and a funding provider’s final review. Available options depend on your business’s circumstances and the providers evaluating your request.
No Legal, Tax, or Investment Advice
Our assistance concerns commercial financing options. Information on our website and in our communications is not legal, tax, accounting, or investment advice.
You should consult your own qualified advisors when evaluating legal, tax, accounting, or investment consequences of a financing arrangement.
Acceptable Use
You agree not to:
Submit false, misleading, fraudulent, or unauthorized information.
Use our website or services for unlawful purposes.
Attempt to access systems, accounts, or information without authorization.
Introduce malicious software or interfere with website security or operation.
Copy or exploit website content in violation of intellectual property rights.
We may suspend or restrict access when reasonably necessary to address misuse, security concerns, legal requirements, or violations of these terms.
Third-Party Providers and Websites
We may refer you to independent funding providers or link to third-party websites. Those parties operate under their own agreements and privacy policies.
We do not control their websites, underwriting decisions, or performance under their agreements. Nothing in these terms excludes responsibility that applicable law places on us for our own conduct.
Intellectual Property
Website content, design, logos, and other materials are owned by Elite Funding Partners LLC or used with permission.
You may view and use these materials for legitimate business inquiries and evaluation of our services. Other reproduction, distribution, modification, or commercial use requires permission from the applicable rights holder, except where permitted by law.
Disclaimer of Warranties
To the fullest extent permitted by law, our website and services are provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and noninfringement.
We do not warrant that the website will always be available, uninterrupted, secure, or free of errors. Nothing in these terms limits warranties or obligations that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, Elite Funding Partners LLC will not be liable for indirect, incidental, special, or consequential damages, including lost profits or business opportunities, arising from use of our website or services.
These limitations do not exclude or restrict liability for fraud, willful misconduct, gross negligence, or any other liability that cannot be limited under applicable law.
Governing Law and Disputes
These terms are governed by the laws of the State of NY, without regard to its conflict-of-law rules.
Subject to applicable law, disputes arising from these terms or our services will be brought in the state courts located in Queens County, NY or the federal courts serving that location. The parties consent to those courts’ jurisdiction.
You may contact us at admin@elitefundingpartner.com to seek an informal resolution of a concern. Doing so does not limit any legal right or extend any filing deadline.
Separate Agreements
A separate written agreement you enter into with us will control over these terms to the extent of a conflict concerning the services covered by that agreement.
Agreements with third-party funding providers govern your financing relationship with those providers.
Changes to These Terms
We may update these terms from time to time. We will post the revised version and update the date above. For material changes, we will provide reasonable advance notice and obtain additional agreement where required by law.
Changes apply prospectively from their stated effective date. Continued use after that date constitutes acceptance to the extent permitted by law. Changes to these terms do not expand your marketing consent.
Severability and Waiver
If a provision is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
